Shipping of Products

 

1. SHIPPING

1.1 Shipping charges:

All orders shipping charges will be based on size & wright of the order and on the location of the delivery. Additional shipping charges may be applied if the order contains larger items. You will be notified of any additional shipping charges due before your order is processed.

 

1.2 Errors & Omissions in Shipments

Customer should check their order and invoice carefully when received.

Please report any errors or omissions to our office (514) 831-5540 within two working days of receiving your shipment so that we can correct the error immediately. ONEHEAD Canada Services LTD will not be held responsible for errors in shipping which are not reported within two working days.

 

2. Returns

Returns are only possible if a manufacturing issue is detected in the first 14 days of usage.

3. Refunds

Due to the nature of the product and the production costs involved, OneHead does not issue any refunds under any conditions.

Terms of Use of Website

Please read this Agreement carefully as it governs the terms of use of ONEHEAD Canada Services LTD website (herein known as “the website” or “the OHCSL Website”).

 

1. AGREEMENT ACCEPTANCE

This Agreement is between you and all persons you represent (including natural persons and any type of incorporated or unincorporated entity, herein known as “the user”) and ” ONEHEAD Canada Services LTD” (herein known as “ONEHEAD “), regarding the access and use of the OHCSL Website, including all content, information, products and services available on or through the OHCSL Website.

With every visit to the OHCSL Website, you signify your acceptance of the terms and to be bound by this Agreement as it reads at the time of the visit, and by visiting the OHCSL Website you represent and warrant that you, the user have the legal authority to agree to and accept this Agreement. If you do not or cannot agree with each provision of this Agreement, you may not access or use the OHCSL Website.

This Agreement, your access to and use of the OHCSL Website, and all related matters are governed solely by the laws of British Columbia and applicable federal laws of Canada. Any dispute between you and ONEHEAD or any other person arising from, connected with or relating to the OHCSL Website, this Agreement, or any related matters (collectively “disputes”) will be resolved before the Courts of British Columbia, sitting in the City of Vancouver, and you hereby irrevocably submit and attorn to the original and exclusive jurisdiction of those courts in respect of all disputes.

If any provision of this Agreement is held to be invalid or unenforceable for any reason, then the provision will be deemed to be severed from this Agreement and the remaining provisions will continue in full force and effect.

This Agreement is in addition to any other agreement you may have with OHCSL.

 

2. PERMITTED WEBSITE USE

2.1 GENERAL USE

You the user, can use the OHCSL Website only if you have can form legally binding contracts under applicable law.

You may not use the OHCSL Website if doing so in your jurisdiction may be considered illegal or prohibited. It is your sole responsibility to determine whether your use of the OHCSL Website is lawful, and you must comply with all applicable laws.

ONEHEAD reserves the right to request proof of age and identification.

 

2.2 LINKING TO OHCSL WEBSITE

Linking to the OHCSL Website without permission is strictly prohibited. To request permission please send an email to [appropriate email address].

ONEHEAD reserves the right to cancel and revoke any permission to link to the OHCSL Website at any time and without any notice or liability.

Displaying the OHCSL Website from within a frame or iframe is also strictly prohibited.

 

2.3 COPYING OR DISTRIBUTING CONTENT

Copying, distributing, mirroring, scraping or data mining of the OHCSL Website or any of its content is strictly prohibited.

 

2.4 USER PROFILES AND LOGIN

For certain parts of the OHCSL Website you will be required to have/create a customer profile with a username and password.  This profile will remain the property of ONEHEAD and may be cancelled or suspended at any time and for any reason by ONEHEAD at its discretion without any notice or liability to you or any other persons.

ONEHEAD is not responsible for verifying the actual identity or authority of any person using your customer profile on the OHCSL Website.

You are fully responsible for the security of any usernames or passwords associated with your customer profile and any and all use or misuse of your profile or the information contained within.

 

3. PERSONAL INFORMATION

3.1 INFORMATION ACCURACY

All personal information submitted to the OHCSL Website must be true, accurate, current and complete. ONEHEAD will rely on the information you submit. You will be solely responsible for and liable for any damage, loss or additional costs as a result of any false, incorrect, incomplete or out of date information.

 

3.2 INFORMATION COLLECTION AND USE

ONEHEAD collects and uses your personal information in accordance with our Privacy Policy that may be changed from time to time without liability by ONEHEAD. By visiting the OHCSL Website and accepting this Agreement, you consent to the collection, use and disclosure of your personal information by ONEHEAD in accordance to our privacy policy as it then reads.

Notices of the changes to the Privacy Policy will be posted on the OHCSL Website, and you will have the option of accepting the changes and accessing the OHCSL Website or declining the changes and being denied access to the OHCSL Website.

 

4. COMMUNICATIONS WITH ONEHEAD

4.1 REVIEWS, COMMENTS, SUBMISSIONS AND SUGGESTIONS AND OTHER CONTENT

Visitors may post reviews, comments, photos, and other content; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “spam.”

You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of any content. ONEHEAD reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content.

Any and all information submitted to ONEHEAD or the OHCSL Website shall automatically grant (or warrant that the owner of the submission grants) to ONEHEAD a perpetual, royalty-free, irrevocable, unrestricted, non-exclusive, world-wide, assignable, sub-licensable, right and license to use and exploit the submissions or any ideas, concepts, know-how or techniques related to the submissions for any purpose whatsoever without providing any compensation to you the user, or any other persons.

 

4.2  DELIVERY OF COMMUNICATIONS TO ONEHEAD

When you visit ONEHEAD.com or send e-mails to us, you are communicating with us electronically. Communications sent to ONEHEAD by means of the OHCSL Website or e-mail are not considered delivered or effective unless and until they are actually received and processed by ONEHEAD’ responsible representative. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on the OHCSL Website. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

 

5. AGREEMENT CHANGES

At the sole discretion of ONEHEAD, this Agreement may be changed and/or updated at any time. By using the OHCSL Website after this revised agreement has been posted, you signify your acceptance and agreement to be bound by the revised agreement. You, the user, may not change or amend this Agreement in any way whatsoever.

Notices of the changes to the Privacy Policy will be posted on the OHCSL Website, and you will have the option of accepting the changes and accessing the OHCSL Website or declining the changes and being denied access to the OHCSL Website.

 

6. ERRORS AND OMISSIONS

ONEHEAD strives to ensure the accuracy of all information on the OHCSL Website. However, errors, misprints, inaccuracies, omissions and other errors may occur.
ONEHEAD does not take responsibility for any errors, misprints, inaccuracies, omissions or any other inaccuracies in any part of the OHCSL Website, including but not limited to product pricing, product information/specifications, or item availability.

ONEHEAD reserves the right to correct any error, inaccuracy or omission at any time without prior notice or liability to you or any other persons.

ONEHEAD reserves the right to change or update any products or services and any information related to those products or services at any time without prior notice or liability to you or any other persons.

 

7. COPYRIGHT AND TRADEMARKS

7.1 COPYRIGHT COMPLAINTS

ONEHEAD is not obliged to monitor, screen, police or edit the use of the OHCSL Website, including postings of materials to the OHCSL Website, although ONEHEAD reserves the right to do so in its discretion. ONEHEAD respects the intellectual property of others.

The compilation of all content on the OHCSL Website is the exclusive property of ONEHEAD and protected by Canadian and International copyright. Your use of the OHCSL Website does not transfer to you any ownership or other rights in the OHCSL Website or its content.

All software used on the OHCSL Website is the property of ONEHEAD or its software suppliers and protected by Canadian and International copyright laws.

TRADEMARK INFORMATION

Other product and company names and logos appearing on the OHCL Website may be registered or unregistered trade names, trademarks and service marks of their respective owners and may or may not be affiliated with, connected to, or sponsored by, ONEHEAD. Nothing appearing on the OHCL Website or elsewhere shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademarks, service marks, trade dress or trade names displayed on the OHCL Website.

LICENSE AND SITE ACCESS

ONEHEAD grants you a limited license to access and make personal use of the OHCL Website and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of ONEHEAD.

This license does not include any resale or commercial use of this site or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this site or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.

ONEHEAD does not assume any responsibility or liability for the actions, product and content of all these and any other third parties links to Other Sites are provided solely for your convenience.

Every effort is made to keep the OHCSL Website up and running smoothly. However, ONEHEAD takes no responsibility for, and will not be liable for, the OHCSL Website being temporarily unavailable due to technical issues beyond our control.

 

9. APPLICABLE LAW

These Terms and Conditions and all related matters are governed solely by the laws of British Columbia, Canada and applicable federal laws of Canada, excluding any rules of private International law or the conflict of laws which would lead to the application of any other laws. The United Nations Convention on contracts for the International Sale of Goods does not apply.

 

PRIVACY POLICY

The OHCSL Website is owned, operated and maintained by ONEHEAD, and will be referred to as the ” OHCSL Website” throughout.

 

1. WE RESPECT YOUR PRIVACY

At ONEHEAD we know how important it is to protect your personal information. Whether you are shopping with us online or in person, we make every customer experience safe and secure.

Any personal information you provide is managed according to the Freedom of Information and Protection of Privacy Act. This means that, at the point of collection, you will be informed that your personal information is being collected, the purpose for which it is being collected and that you have a right of access to the information. Our policy is designed to meet or exceed the requirements of Canadian Federal and Provincial privacy laws. We constantly self-evaluate our practices and procedures to maintain the highest standard in this regard.

We have developed this Privacy Policy to outline our guidelines for the collection and use of personal information. At ONEHEAD, we collect two types of information; personal information and non-personal information.

 

2. PERSONAL INFORMATION

Personal information typically includes your name, address, phone number, and email address. You can always choose not to provide us with any of your personal information. However, if you make this choice, we may not be able to provide you with the product, service, or information that you requested. For example, we can only process online orders if you have provided us with the required financial information. With your consent we may use your personal information for a number of different purposes, including:

 

  • Fulfil requests for products, services or information;
  • Provide customer services;
  • Administer contests or promotions;
  • Offer new products and services;
  • Measure and improve the effectiveness of the OHCL Website or our marketing endeavours and in our online or in-store offerings, to your preferences.

 

3. NON-PERSONAL INFORMATION

Non-personal information does not identify you as an individual. For example, we may ask you for your postal code to assist us with planning our flyer distribution.

We may also collect and summarize customer information in a format that, for our statistical purposes, no longer identifies the individual.

 

4. CONSENT OF INFORMATION USE

In some cases, your consent is implied if we ask you to provide personal information with a stated purpose. For example, we can only deliver the product you have purchased if you provide us with your address and phone number.

In other cases, we will ask you to give your consent to use your personal information to advise you of products or services that may be of interest. You always have the opportunity to “opt out” of having your information used for this purpose.

If you have “opted in” or subscribed to one of our newsletters or mailing lists, we will always provide you the opportunity to “opt out” or unsubscribe. For example, each e-mail we send you will tell you how to decline further e-mails.

 

5. IN-STORE PURCHASES

When you purchase a ONEHEAD product or service, you may need to provide us with contact and payment information (such as credit or debit card information) so that we can process your request. Examples where we need contact information include delivery services, product servicing, in-salon treatments, warranty coverage, and rebate requests. If we collect this information, we will also ask for your consent to use this information to send you promotional information on products and services.

 

6. CONTESTS, PROMOTION AND SURVEY

From time to time, we may run contests, promotions or surveys. If you participate, you may be asked for contact information as well as additional optional survey information (for example, product preferences). Information from contest entries will be used to contact you if you win. We may also summarize survey information in a manner that no longer identifies the contest entrants for analysis, but will not share personal information from entries. All contests are subject to rules that will be available with each particular contest.

 

7. THE OHCL WEBSITE

While using the OHCSL Website, you may be asked to voluntarily provide certain personal information (such as your name, email address, postal address, telephone number, or credit or debit card information). We use this information to complete your transaction and to apply for access to certain special features and functions of the OHCSL Website. If you choose not to provide requested personal information, you will not be able to use certain features of the OHCSL Website and you will not be able to engage in transactions through the OHCSL Website.

With any of the services on the OHCSL Website, we may also use your personal information to contact and correspond with you and to respond to your inquiries. 8. INFORMATION COLLECTED AUTOMATICALLY

Like many other websites, we automatically collect information in regards to your browsing activities on the OHCSL Website, which information includes your computer’s IP address, the IP address of your internet service provider, the date and time that you access the OHCSL Website, the IP address of the website from which you linked directly to the OHCSL Website,  the operating system you are using, the sections of the OHCSL Website you visit, the OHCSL Website pages read and the images viewed, and the content you download from the OHCSL Website.

When you visit this web site, our web server automatically collects a limited amount of standard information essential to the operation and evaluation of the OHCSL Website. This information includes:

 

  • The page from which you arrived;
  • The date and time of your page request;
  • The IP address your computer is using to receive information;
  • The type and version of your browser; and
  • The name and size of the file you request

 

This information helps us assess the OHCSL Website and is used to make your browsing experience more enjoyable and efficient.

All information is collected in compliance with section 33 of the Freedom of Information and Protection of Privacy (FOIP) Act of British Columbia.

This information is collected in order to help make our site more useful to visitors, to learn about the number of visitors to our site, and to learn about the types of technology our visitors use. We do not track information about individuals and their visits. We will not identify users or their browsing activities, except as required by a law of Canada or if we are compelled to produce this information for a legal proceeding.

For security purposes and to ensure that this service remains available to all users, this computer system employs software programs to monitor network traffic to identify unauthorized attempts to upload or change information, or otherwise cause damage.

Except for authorized law enforcement investigations, no other attempts are made to identify individual users or their usage habits.

 

9. COOKIES

The OHCSL Website uses “cookies”, a technology that installs a small amount of information on a website user’s computer to permit the OHCSL Website to recognize future visits using that computer. Cookies enhance the convenience and use of the OHCSL Website. For example, the information provided through cookies is used to recognize you as a previous user of the OHCSL Website (so you do not have to enter your billing information every time), to offer personalized web page content and information for your use, to track your activity at the OHCSL Website, to respond to your needs, and to otherwise facilitate the OHCSL Website experience. 12. DISCLOSURE OF INFORMATION

ONEHEAD does not sell your personal information. However, we may share your information with third parties acting on our behalf as is necessary for providing our services to you, as permitted or required by law, or as authorized by you.

ONEHEAD may share your personal information with certain service providers in order to provide products and services to you, to verify and validate information, and to address customer service matters. Examples of service providers include credit card issuers, product service depots, warranty providers, and delivery services. To reduce the risk of fraud or misuse of personal information, ONEHEAD may also verify your personal information, including but not limited to your address and credit card information with third party service providers.

We will use reasonable efforts to ensure that your personal information is used in a manner that is consistent with this Policy. If you do not wish us to provide your personal information to those service providers, we may be unable to process your transaction.

ONEHEAD may disclose your information as permitted or required by law:

 

  • To a government institution or other person or entity that has asserted its lawful authority to obtain the information;
  • To comply with a subpoena or warrant or an order made by a court, person or entity with jurisdiction to compel the production of information;
  • To comply with court rules regarding the production of records and information; or

13. HOW WE PROTECT YOUR INFORMATION

The security of your personal information is a high priority for ONEHEAD. We maintain appropriate safeguards and current security standards to protect your personal information, whether recorded on paper or captured electronically, against unauthorized access, disclosure, or misuse.

Although we cannot take responsibility for any theft, misuse, unauthorized disclosure, loss, alteration or destruction of data by a third party, we take reasonable precautions to prevent such unfortunate occurrences.
